SHOWS, THEATERS, AND STREET PERFORMANCES | |||||
110.01 LICENSE REQUIRED | ||
Any person who exhibits or participates in exhibiting in the city for payment or reward charged, demanded, or received, a theatrical performance; a show of puppets; vaudeville entertainment or a minstrel show; wax figures; animals; a display of tumbling; rope or wire dancing or balancing; sleight of hand; a boxing or wrestling match; a circus; a menagerie; natural or artificial curiosity; deception or representation; a phonograph or electrical device; a musical concert; a swing or merry-go-around; a bowery dance; roller skating; a rink or bowling alley; a pool or billiard table; an alley, machine device, or place of any kind for sports or games, kept for hire or pay, and recognized by law as legitimate; or any display or performance of the same general description, as those listed, shall obtain a license. | ||
110.02 LICENSE REQUIREMENT EXCEPTIONS | ||
The provisions of 110.01 shall not be applied to any entertainment or performance given in the interest of any religious or benevolent society or purpose, or to a lecture on scientific, historic, benevolent, or literary subjects, or when the proceeds are to be devoted exclusively to any public, municipal, literary, or scientific purpose or benevolent society, or to the benefit of any fire company or musical organization of the city. | ||
110.03 LICENSE FEES | ||
The amounts to be paid for licenses for amusements and entertainments shall be as follows: | ||
1) | Theatrical performances and vaudeville or minstrel shows held within doors, $2.50 per day or night. | |
2) | Circuses or menageries, including street parades where admission is $.50 or more, $25 per day. Where the admission fee is less than $.50, $15 per day. | |
3) | Merry-go-rounds and mechanical swings or similar appliances, $5 per day. | |
4) | Skating rinks, $2.50 per day, $5 per week, $8 per month, or $25 per year. | |
5) | Shooting galleries, tables, machines and devices for sports or games, billiard or pool rooms, and bowling alleys, all within doors, $1 per day, $3 per week, $5 per month, $10 per year. | |
6) | Street shows, performances and exhibitions from wagons or small tents, side shows, exhibitions of tumbling, sleight of hand, boxing or wrestling matches, puppets, wax figures, natural or artificial curiosities, street concerts, mechanical figures, phonographs and electrical machines, rope or wire walking or dancing, and bowery dances, $2.50 per day. | |
7) | Circus parades or menagerie parades where shows are held outside city limits and not licensed, $5 per day. | |
110.04 GAMBLING PROHIBITED | ||
Gambling machines, devices, and tables or implements shall not be licensed, and any license issued under false representations as to the use intended shall be forfeited and surrendered. | ||
POOL TABLES AND OTHER GAMING DEVICES | |||||
110.05 LICENSE REQUIRED | ||
No person shall keep for hire within the corporate limits of the city, any billiard, pool, bagatelle, pigeon hole table, or other tables to be used for any game for hire or gain, without obtaining a license so to do. Such license shall contain a description of the location, room, or place where the table or tables are kept and operated, and the number of each. | ||
110.06 LICENSE FEES | ||
The fees to be paid for licenses shall be as follows: For each original pool table, billiard table, bagatelle table, pigeon hole table, or other table upon which any game is played for hire or gain, the sum of $10, and $5 for each succeeding table thereafter per year. Upon payment of the fee to the Clerk-Treasurer of the city, the Clerk-Treasurer shall issue a license to the person so applying, authorizing him to conduct and operate the games and sports specified therein at the location, room, or place therein described, for one year thereafter. | ||
110.07 REVOCATION OF LICENSE | ||
If any billiard, pool, or other table used for games, or the rooms in which they are kept and operated, shall be conducted in violation of this chapter or the law of the state or the United States of America, or made a gathering place for noisy or boisterous persons or persons of lewd or bad character, or if indecent or unlawful conduct is practiced by the patrons of the room and devices, or if a complaint has been filed against any person to whom a license has been granted, and if it is found upon a hearing of the complaint that the licensee has violated the laws of the state or the United States of America in reference to his business, or that he has permitted a violation, the Mayor shall revoke or suspend the license. | ||
110.08 HOURS OF OPERATION | ||
No person who owns any billiard, pool, or other table used for games shall permit the table to be played upon or used by any person except during the following hours: |
Monday through Thursday, 11:00 a.m. until 11:00 p.m. | ||
Friday and Saturday, 11:00 a.m. until 12:00 p.m. | ||
110.09 UNOBSTRUCTED VIEW OF INTERIOR | ||
No person shall occupy any room in the city for the purpose of keeping or operating any billiard, pool, or other table used for games unless the room has windows of ample size so located that a full and unobstructed view of the interior of the room is available from the street at all times. There shall be no screens, curtains, counters, partitions, or other obstructions to interfere with the view of the entire interior of the room from the windows facing a public street. | ||
110.99 PENALTY |
A) | Any person who violates the provisions of 110.01 through 110.04 shall, upon conviction, be fined not more than $50. | |
B) | Any person who violate 110.05 through 110.09 shall, upon conviction, be fined not less than $10 nor more than $100. Each day's continuance shall constitute a separate offense. |
