    155.01 DEFINITIONS
    The following definitions apply throughout this chapter:
        
    CLASS 1 STRUCTURE  
    Any structure defined as a "CLASS 1 STRUCTURE" pursuant to I.C. 22-12-1-4.
    CLASS 2 STRUCTURE  
    Any structure defined as a "CLASS 2 STRUCTURE" pursuant to I.C. 22-12-1-5. The term includes "one-family dwelling," "single-family dwelling," "two-family dwelling" and "duplex."
    DWELLING UNIT  
    The room or rooms that form a single residential unit, providing complete independent living facilities for one or more persons, including permanent provisions for living, sleeping, eating, cooking and sanitation.
    ELECTRICAL WORK  
    The installation, alteration or repair of electrical system components, including but not limited to wiring, conduit, switches, electric service panels, outlets and related devices, in or on any Class 1, Class 2 or other structure regulated by Chapter 151 of this code.
    155.02 LICENSE REQUIRED
        
    A) License required  
    Any person who engages in electrical work in the city shall possess an electrician's license that was issued to that person by the city's Department of Building, Planning and Development for the type of structure on which the electrical work is to be performed, in accordance with the requirements in this chapter.
    B) Owner-occupant exemption  
    Any person who performs electrical work within or on the dwelling unit that they own in whole or in part and occupy as their primary residence, shall be exempt from the requirement to obtain a license under the terms of this chapter. Where the owner-occupant's building also contains additional dwelling units, or contains non-residential uses, this exemption shall apply only to components of the electrical system that serve only the owner-occupied dwelling unit, and that are within or on the interior and exterior of the owner-occupied dwelling unit, and shall not extend to any other electrical component of the same building, nor to any shared electrical components of the same building, nor to any other interior or exterior part of the same building.
    C) Building trades exemption  
    High school building trades students shall be exempt from the requirement to obtain a license under the terms of this chapter while working on a building trades project.
    D) Maintenance exemption  
    Any person who is employed as a maintenance person at a manufacturing facility, and who performs electrical work in order to maintain the production, manufacturing and assembly equipment necessary to maintain productivity in the facility where that person is employed, shall be exempt from the requirement to obtain a license under the terms of this chapter.
     
    155.03 SITE IMPROVEMENT PERMITS
    A) The owner-occupant of a dwelling unit who qualifies as being license-exempt under the terms of 155.02(B) in this chapter shall be authorized to obtain a site improvement permit to perform electrical work authorized in that section.
    B) A person who holds a license as a master electrician shall be authorized to obtain site improvement permits to perform electrical work on any Class 1, Class 2, or related structures.
    C) A person who holds a license as a master residential electrician shall be authorized to obtain site improvement permits to perform electrical work on any Class 2 or related structures, but not on Class 1 or related structures.
    D) A person who holds a license as an electrical contractor shall be authorized to obtain site improvement permits to perform electrical work on any Class 1, Class 2 or related structures, subject to the following restrictions:
     
    1) When the electrical contractor has a master electrician assigned to supervise the electrical work, a permit may be obtained for any class of structure.
    2) When the electrical contractor has a master residential electrician assigned to supervise the electrical work, a permit may be obtained only for Class 2 or related structures, but not Class 1 or related structures.
      
    This provision shall be valid only through December 31, 2001.
    E) Permits not authorized  
    A site improvement permit to perform electrical work shall not be issued to a person holding a license as a journeyman electrician, journeyman residential electrician or apprentice electrician.
     
     
    155.04 RESPONSIBILITY FOR WORK
    The electrical contractor, master electrician, master residential electrician, or owner-occupant of a dwelling who obtains a site improvement permit for electrical work, shall be responsible for ensuring that all electrical work authorized by the permit is completed in compliance with all regulations and permits that apply to the work.
    155.05 LICENSES
    A) Classes of license  
    The following classes of licenses shall be issued by the city subject to satisfactory completion of the requirements in this chapter for each class:
     
    1) Master electrician  
    A license issued to a person who has correctly answered at least 70% of the questions on the examination for master electrician, and who has not less than four years of equivalent full-time experience performing electrical work on any combination of Class 1 and Class 2 structures.
    2) Journeyman electrician  
    A license issued to a person who has correctly answered at least 70% of the questions on the examination for journeyman electrician, and who has not less than two years of equivalent full-time experience performing electrical work on any combination of Class 1 and Class 2 structures.
    3) Master residential electrician  
    A license issued to a person who has correctly answered at least 70% of the questions on the examination for master residential electrician, and has who has not less than two years of equivalent full-time experience performing electrical work on Class 2 structures.
    4) Journeyman residential electrician  
    A license issued to a person who has correctly answered at least 70% of the questions on the examination for journeyman residential electrician, and has who has not less than two years of equivalent full-time experience performing electrical work on Class 2 structures.
    5) Apprentice electrician  
    A license issued to a person for the purpose of performing electrical work under the supervision of any person licensed in accordance with the requirements in this chapter, except another apprentice electrician.
     
    B) Reciprocal license  
    A reciprocal electrician's license will be issued to an applicant for any class of license in this chapter except apprentice electrician, subject to the applicant satisfying both of the following requirements:
     
    1) Having completed the work experience required in this chapter for the class of license to be issued; and
    2) Having passed an electrician's certification examination administered by a state agency in any of the 50 states (but not by a political subdivision of a state), which resulted in the issuance of a license by that state that is equivalent to the class of license authorized in this chapter for which the applicant is applying, based on evidence of electrical work having been performed on structures that are equivalent to Class 1 and/or Class 2 structures.
     
    155.06 ISSUANCE AND EXPIRATION OF LICENSES
    A) Issuance of license  
    Each license will be issued by the Department of Building, Planning and Development within three working days after receipt of all of the following:
    1) Completion of the city's license application form, including the required minimum number of years of experience;
    2) Official notification of a score on the required test that satisfies the testing requirements in this chapter; and
    3) Payment of required fees.
     
    B) Expiration of license  
    Each license shall be valid for one year from the date on which the license was issued.
    155.07 TESTING STANDARDS
    A) Examinations  
    An applicant's score on:
     
    1) Previous, current or future versions of the following tests administered by Experior Assessments, LLC, of Gainesville, Florida, or their successor; or
    2) Tests that are equivalent in scope and content to the following Experior Assessments, LLC, tests; or
    3) Previous versions of the following Experior Assessments, LLC, tests that were previously administered by Block & Associates, will be used to determine eligibility for issuance of a license in the specified class:

    155.08 APPLICATION AND PROOF OF EXPERIENCE
     
    A) Application  
    The application for an electrician's license shall be in the form provided by the city. The applicant shall complete, sign and date the application, and submit it to the city's Department of Building, Planning and Development.
    B) Experience  
    Proof of experience in electrical work shall be provided by the applicant on the application form, including the names of previous employers, dates and duration of employment, and types of structures on which the electrical work was performed, e.g., Class 1 (commercial, industrial or multi-family residential), or Class 2 (one and two-family residential).
     
    155.09 FEES
                                                      
    A) Testing fees  
    A testing fee shall be paid directly to the testing agency in accordance with their policies. The city does not assess fees for testing.
    B) Licensing fees  
    A license fee shall be paid to the city prior to issuance of each license, and annually thereafter for each license that is re-issued, based on the following schedule:

    155.10 PENALTIES
     
    A) Fine  
    Any person who performs electrical work in violation of any of the terms of this chapter shall be fined $25 per violation. Each day that a violation continues is a separate offense.
    B) Revocation of license  
    The license of an electrician shall be revoked for the performance of electrical work that does not comply with the requirements of Chapter 151 of this code, and any other adopted requirements of the city. A new license will be issued to a person whose license was revoked under the terms of this chapter only after that person has satisfactorily completed all of the following requirements:
     
    1) Taken and passed in accordance with the requirements of this chapter, the most recent version of the test for the class of electrician's license for which they are applying, regardless of whether or when they may have previously taken and passed the same test; and
    2) Completed all requirements in this chapter for issuance of a license.
     
    155.11 APPEALS
    An appeal of any of the terms of this ordinance shall be made in writing to the city's Board of Public Works and Safety.
