    153.01 DEFINITIONS
     
    The following definitions and abbreviations apply throughout this chapter unless the context clearly indicates or requires a different meaning:
               
    ADMINISTRATOR 
    The administrator of the Department of Building, Planning and Development of the City of Auburn.
    BOARD 
    The Board of Public Works and Safety of the City of Auburn.
    CITY 
    The City of Auburn, Indiana.
    CLASS 1 STRUCTURE 
    Any structure defined as a Class 1 structure pursuant to IC 22-12-1-4, as from time to time amended.
    CLASS 2 STRUCTURE 
    Any structure defined as a Class 2 structure pursuant to IC 22-12-1-5, as from time to time amended. The term includes “one-family dwelling,” “single-family dwelling,” “two-family dwelling” and “duplex dwelling.”
    DEPARTMENT 
    The Department of Building, Planning and Development of the City of Auburn.
    DWELLING UNIT 
    The room or rooms that form a single residential unit, providing complete independent living facilities for occupancy by one or more persons, including permanent provisions for living, sleeping, eating, cooking and sanitation that comply with the requirements for a Class 2 structure.
    PLUMBING WORK 
    The installation, alteration or repair of plumbing system components, including but not limited to water and wastewater system pipes, fixtures and related devices, in any Class 1 or Class 2 structure, or any other structure regulated by Chapter 151 “Building Code” of the Municipal Code of the City of Auburn.
    153.02 AUTHORITY
    The administrator of the Department of Building, Planning and Development of the City of Auburn is authorized and directed to administer the provisions of this chapter.
    153.03 STANDARDS
    The applicable provisions of IC 25-28.5-1-32 and 675 IAC 16, as from time to time amended, shall apply throughout this chapter.
    153.04 REGISTRATION REQUIRED
    A) Any person who engages in plumbing work within the city shall be registered in accordance with the requirements in this chapter.
    B) Any person who performs plumbing work under any of the following conditions is exempt from the requirement to be registered as a plumber with the City. Exemptions (1) to (9) of this section are exemptions under IC 25-28.5-1-32, and any amendment to or repeal of a provision of IC 25-28.5-1-32 shall immediately amend or repeal the same provision in this section.
       
    1) Bridge, road and railroad exemption 
    Contractors in work on bridges, roads, streets, highways, railroads, or utilities and services incidental to the work.
    2) Government exemption 
    An authorized employee of the United States, the state, or a political subdivision of the state if the employee does not profess to be for hire and is acting within the scope of the employee's employment.
    3) Court appointed officer 
    An officer appointed by a court when the officer is acting within the scope of the officer's office as defined by law or court order. When construction projects are not underway at the time of the appointment of the officer by the court, and the nature of the officer's appointment requires that plumbing must be done, the officer must employ or contract with a registered plumbing contractor or journeyman plumber.
    4) Public utility exemption 
    Public utilities with respect to construction, maintenance, and development work performed by their own forces and incidental to their business.
    5) Owner-occupant exemption 
    The owner occupant of a dwelling of eight or less residential units when the owner occupant is installing, altering, or repairing the plumbing system of the residential units.
    6) Federal land and federal law exemption 
    Construction, alteration, improvement, or repair of a plumbing system, located on a site, the title of which is in the name of the United States of America, or to construction, alteration, improvement, or repair on a project where federal law supersedes this article.
    7) Employee maintenance exemption 
    An individual who is employed or acts as a maintenance person at the individual's place of employment.
    8) Farmstead exemption 
    Farmsteads, except for buildings built on the farmstead for the purpose of public or commercial use.
    9) Utility contractor exemption 
    A sewer contractor, sewage disposal contractor, or an excavation contractor or utility contractor who generally engages in the business of installing, altering, or repairing sewers, private or public sewage disposal systems, and water distribution or drainage lines outside the foundation walls of a building.
    10) Building trades exemption 
    High school building trades students while working on a building trades project on which a registered plumber is also employed, and only when the registered plumber is present during the performance of any plumbing work.
    153.05 SITE IMPROVEMENT PERMITS
    The following persons shall be authorized to obtain a site improvement permit for the specified plumbing work:
       
    A) A person who is registered as a plumber in accordance with this chapter may obtain a site improvement permit for plumbing work on any Class 1, Class 2 or related structure in the city.
    B) The owner-occupant of a dwelling unit performing work under the owner-occupant exemption in this chapter may obtain a site improvement permit for the plumbing work authorized on the dwelling unit(s).
    C) A person performing work under the employee maintenance exemption in this chapter may obtain a site improvement permit for the plumbing work authorized on any building in which they are the maintenance person.
    D) A person performing work under the farmstead exemption in this chapter may obtain a site improvement permit for the plumbing work authorized on the exempt buildings.
    153.06 RESPONSIBILITY FOR WORK
     
    The individual who obtains a site improvement permit for plumbing work shall be responsible for ensuring that all work authorized by that permit is completed in compliance with all city and other regulations that apply to the work.
    153.07 APPLICATION FOR AND ISSUANCE OF REGISTRATION
    A) Application 
    Each applicant for registration as a plumber shall complete and file the following with the city’s Department of Building, Planning and Development:
    1) An application for registration in the form provided by the Department; and
    2) A copy of the applicant's current and valid plumber contractor license.
    B) Issuance 
    A registration shall be issued after:
     
    1) The application form and the state plumber contractor license have been reviewed and approved by the administrator of the Department; and
    2) A registration fee of $20 has been paid the city for each initial registration and each renewal registration.
    153.08 EXPIRATION OF REGISTRATION
    Each registration shall be valid for a period of time that is the shorter of:
     
    A) The calendar year in which the registration was issued; or
    B) The termination of the state plumber contractor license.
    153.09 APPEALS
     
    A) Administrative appeal 
    An appeal of any of the terms of this chapter or any decision of the Administrator shall be made in writing to the city's Board of Public Works and Safety.
    B) Decision of the board
    The decision of the Board on any appeal shall be final, subject to review by certiorari.
    C) Cessation of work 
    No person whose plumbing registration has been revoked may perform plumbing work in the city, and no work may be performed under a permit issued to that person, until either:
     
    1) The city’s Board of Public Works and Safety has authorized the person is again registered as a plumber in accordance with the terms of this chapter; or
    2) An appeal has been denied by the Board but overturned by a court of competent jurisdiction, and the Board does not appeal the court's decision.  
    153.99 PENALTY
    A) Fine 
    Any person who performs plumbing work in violation of any of the terms of this chapter shall be fined $25 per violation. Each day that a violation continues is a separate offense.
    B) Revocation of registration 
    The registration of a plumber shall be revoked for the performance of plumbing work that does not comply with the requirements of either Chapter 151 “Building Code” or any other adopted standards of the city.
    C) Renewal of revoked registration 
    A person whose registration has been revoked under terms of this chapter may renew their registration only after completing the following requirements:
    1) An application has been made in writing to the city’s Board of Public Works and Safety requesting reinstatement as a registered plumber, including evidence that the reason(s) for which the registration was revoked has been resolved;
    2) The Board has approved renewal of the registration; and
    3) All requirements in this chapter for renewal of a registration have been completed, whether or not the person has already been registered with the city as a plumber in the current calendar year.
