    CHAPTER 116: FARMERS' MARKET
    116.01 Establishment of market

    116.01 ESTABLISHMENT OF MARKET
     
    A) The Auburn Business Association, or its successor, is hereby authorized to conduct an "Auburn Farmers' Market" during the months of May, June, July, August, September, and October.
    B) The market shall be located along the east side of South Main Street beginning at the first parking place north of the intersection of South Main Street and Ninth Street, and extending as far northward along South Main Street as may be necessary to accommodate participants.
     
    116.02 FEE; DAYS AND HOURS
    The Auburn Business Association may charge a fee to vendors participating in the market to cover incidental costs. Market days and hours shall be established by the Auburn Business Association.
    116.03 REGULATION OF VENDORS
     
    A) All selling shall be done from the rear of vehicles backed into the established parking space. No selling shall be done from the street side of the vehicle. No part of a vehicle shall extend more than 20 feet from the curb, such measurement made from the curb on a perpendicular line.
    B) Sections of the code of ordinances applicable to itinerant vendors, to backing into parking spaces, and to parking limitations, shall not be applicable to participants during market hours.
    116.04 OPERATION OF MARKET
    In respect to the operation of the market, the Auburn Business Association shall comply with the following requirements:
        
    A) The farmers' market area shall be kept in a clean, sightly, and healthful condition, free from debris and offensive odors.
    B) Sidewalks within the area shall be kept free from any obstruction whereby the passage of persons thereon would be hindered.
    C) Upon the cessation of the farmers' market activities on any market day, the area shall be promptly vacated and placed in the same condition of sightliness, healthfulness, and cleanliness as existed prior to such market activity on that day.
    D) The Auburn Business Association shall designate a chairman of the farmers' market who shall be the contact person with the city and its respective departments.
    E) The market shall not be held during the period of the Auburn-Cord-Duesenberg Festival and the DeKalb County Free Fall Fair. The Common Council or the Board of Public Works and Safety of the city may designate other days during which the farmers' market shall not be held due to conflict with other community activities.
    F) The city and its respective departments, officers, and employees shall be held harmless from any and all liability of any kind or character incurred or asserted as a result of the farmers' market.
