RESOLUTION FINDING NONCOMPLIANCE
REGARDING PROPERTY TAX PHASE-IN
 
Summary
 

  WHEREAS, the City of Auburn, Indiana Common Council previously passed Resolution 05-2015, a resolution qualifying new equipment for property tax phase-in for LIPPERT COMPONENTS MANUFACTURING, INC. The resolution was for five (5) years for new manufacturing equipment with an approximate cost of $750,000.00 and logistical distribution equipment with an approximate cost of $50,000.00. Since that time, LIPPERT COMPONENTS MANUFACTURING, INC. has not installed said equipment. The Auburn Common Council on June 7, 2016, found that LIPPERT COMPONENTS MANUFACTURING, INC. was not in compliance with Form CF-1/PP Compliance with Statements of Benefits for Personal Property because the equipment had not been installed. On said date, the Council voted that the LIPPERT COMPONENTS MANUFACTURING, INC. was in noncompliance and in accordance with I.C. 6-1.1-12.1-5.1 and I.C. 6-1.1-12.1-5.9 the designated body sent the property owner written notice of noncompliance and held a hearing on June 21, 2016, at 6:00 p.m. before the Common Council. At said hearing the Common Council conducted a hearing in accordance with Indiana law and found that the tax phase-in was not in compliance and Form CF-1/PP was forwarded to the DeKalb County Auditor indicating noncompliance and revocation of the tax phase-in.
The resolution also sets forth that the Clerk-Treasurer will file a certified copy of this same resolution with the County Auditor and / or Assessor as required by law. RESOLUTION FINDING NONCOMPLIANCE
REGARDING PROPERTY TAX PHASE-IN
 

WHEREAS, the Common Council of the City of Auburn, Indiana, has approved economic revitalization and tax phase-in pursuant to the provisions of I.C. 6-1.1-12.1 et seq. and ordinance number 86-22; and
 WHEREAS, LIPPERT COMPONENTS MANUFACTURING, INC. received property tax phase-in under Resolution 05-2015; and
 WHEREAS, LIPPERT COMPONENTS MANUFACTURING, INC. has provided Form CF1/PP Statement of Benefits for Personal Property as it relates to the proposed roto mold equipment and transportation equipment that was to be installed at 1000 Auburn Drive, Auburn, Indiana 46706, for LIPPERT COMPONENTS MANUFACTURING, INC.; and
 WHEREAS, after inspection and hearing a report to Council and hearing on said matter the Common Council has found that LIPPERT COMPONENTS MANUFACTURING, INC. of 3501 E CR 6, Elkhart, Indiana 46514, is not in compliance with the Statement of Benefits for Personal Property as it relates to the tax phase-in associated with Resolution 05-2015 which would have allowed new manufacturing equipment and logistical distribution equipment to be phased in over a five (5) year period.
 NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF AUBURN, DEKALB COUNTY, INDIANA, THAT:
 The Common Council has voted to deny Form CF-1/PP Compliance with Statement of Benefits for Personal Property provided by LIPPERT COMPONENTS MANUFACTURING, INC. and to revoke the tax phase-in previously granted under Resolution 05-2015.
 The Compliance with Statement of Benefits form denying said application has been executed and previously delivered to the Auditor/Assessor of DeKalb County, Indiana, setting forth that said tax phase-in has been rejected and that the applicant’s Compliance with Statement of Benefits has been found to be in noncompliance. A copy of this Resolution shall be provided to the Auditor/Assessor of DeKalb County, Indiana, and to the owner of record of LIPPERT COMPONENTS MANUFACTURING, INC., 3501 E CR 6, Elkhart, Indiana 46514.
ADOPTED BY THE COMMON COUNCIL OF THE CITY OF AUBURN, INDIANA, ON THE ____ DAY OF _______________, 2016.
